Parties and Account Ownership

MangoBeds PMS software (hereinafter called “the system”) is a service provided by Human Does LLC (hereinafter called “Human Does” or “MangoBeds” to simplify the lecture), a company registered in the United States. The subscription holder and account owner (hereinafter called “the client/customer”) is the person whose email and contact information were originally used to sign up. If the person signed up on behalf of an employer, then the employer shall be the account owner.

In the event of a dispute regarding account ownership, MangoBeds reserves the right to request documentation to determine or confirm account ownership. Documentation may include, but is not limited to, a scanned copy of your business license, government-issued photo ID, the last four digits of the credit card on file, etc. MangoBeds retains the right to determine, in its sole judgment, rightful account ownership and transfer an account to the rightful owner, or to temporarily disable an account until resolution has been determined.

Approval of Terms and Conditions

The customer approves these terms and conditions by registering on the MangoBeds website. MangoBeds may occasionally adjust the terms and conditions. By continuing to use the MangoBeds system after those changes are made, the customer agrees to the updated terms.

Scope and Use

The subscription gives the customer the right to use the MangoBeds system for their accommodation management. The subscription cannot be used by others or for data processing for others. The customer is only entitled to use the system for the intended purposes. If the system is misused, MangoBeds reserves the right to terminate the subscription without warning. Any damages or losses to MangoBeds caused by misuse may result in the customer being held liable.

Terms of Payment and Invoicing

Billing is processed every month or year depending on the subscription. The account will be terminated if no payment is received in 60 days.

Duration and Termination

The customer may use the MangoBeds system as long as the account balance is positive. Payments made are non-refundable. Accounts may be terminated 60 days after a negative balance or by customer request.

Customer Data

The customer owns the data entered into the MangoBeds system and can use it as they see fit. Reservations will be stored for at least 12 months from the check-out date, but may be deleted thereafter. On termination, the customer may export their data via the export function. Customer data will be permanently deleted one year after termination or earlier if requested by the customer.

MangoBeds may process customer data through agents, sub-processors, or contractors as necessary.

Operational Stability

MangoBeds aims for the highest operational stability but is not responsible for interruptions caused by factors beyond its control, such as power failures or connection issues.

Maintenance and System Changes

MangoBeds may occasionally perform system updates or maintenance that may require temporarily shutting down system access. MangoBeds reserves the right to update, improve, or change the system’s functionality as long as a basic service, such as reservation management, is maintained.

Pricing

MangoBeds will announce any price increases at least one month in advance, except in cases of inflation, exchange rate volatility, or third-party price increases. New features or modules may be priced separately.

Intellectual Property Rights

The MangoBeds system and all related intellectual property, including trademarks, logos, and copyrights, are owned by MangoBeds. These rights may be transferred to third parties, provided that the system is maintained according to these terms.

Customer Obligations

The customer is responsible for ensuring the accuracy of data entered into the system. Customers must not use the system in ways that interfere with others’ use of the system. Offensive or misleading information is prohibited. The customer’s sole remedy for dissatisfaction with the system is to stop using it.

MangoBeds’ Obligations

MangoBeds provides the system “AS IS” without any express or implied warranty. MangoBeds is not responsible for third-party applications, products, or services linked to or provided through the system. Customers use the system at their own risk.

Disclaimers

MangoBeds is not liable for direct or indirect damages, loss of profits, revenue, contracts, goodwill, or other types of losses. MangoBeds is not responsible for errors, overbookings, or service issues caused by external booking platforms or customer mismanagement.

Channel Manager and External Systems

The customer is responsible for ensuring that room types and availability are correctly synced with external booking platforms. MangoBeds is not responsible for overbookings caused by multiple booking channels.

Credit Card Information and Payments

MangoBeds processes payments through third-party providers and does not act as the merchant of record. MangoBeds is not liable for any unauthorized or incorrect charges processed by the customer or third-party payment processors.

Privacy and Data Protection

MangoBeds complies with the General Data Protection Regulation (GDPR) and any applicable data protection laws. Customer data is processed solely for the services provided by MangoBeds. MangoBeds will only disclose customer information if necessary for service delivery. Customers are responsible for obtaining consent for data processing from their guests and must comply with any requests to share, modify, or delete personal data.

Disputes

In case of any discrepancies between translated versions of these terms, the original English version shall prevail
